The “Southern Oregon Last Band Standing” (LBS) 2013
Contest Official Promotional Rules

  

Who Can Enter 

1. To be eligible to participate in this contest, entrants must be legal U.S residents who are 18 years of age or older and have a valid Social Security number at the time of entry.  Registrants ages 18-20 will be ONLY be allowed with prior written authorization from Opus Broadcasting, Inc. Any performer ages 18-20 have to be cleared through OLCC and Legacy Entertainment BEFORE Wednesday, June 26, and may only be either on the stage or in the alley. They may not at any time come down from the stage into the public area of Havana Republic/Grotto Patio. This Contest is open to musical groups comprised of two (2) or more members who perform original music “live” on stage only.  Those not eligible to participate or win include musical groups performing non-original works or “covers.  Amateur bands and those that have not signed with any major recording labels are eligible to participate. 

2.  Employees of Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc., WSMH, Inc. and any other company which owns, programs or provides other services to television broadcast station KTVL-TV (the “Station”),  Legacy Entertainment dba Havana Nightclub, Opus Broadcasting dba KROG (“Opus”), The Douglas Group, Inc. dba UPICKEM, their affiliated companies, advertising and promotion agencies, any and all local television broadcast and cable stations, local radio and other media companies, and the immediate family members of each are ineligible.  The term “immediate families” includes spouses, grandparents, parents, siblings, children and grandchildren.

How to Enter

1.  No purchase is necessary to enter.  Only one entry per musical group. Previous “Southern Oregon Last Band Standing”  winners may not compete.

2.   To enter, musical groups must complete and submit an entry packet to Opus Broadcasting, which must include a sample of the musical group’s original music either in hard copy CD or via online submission.  The entry packet may be obtained at Opus Broadcasting at 511 Rossanley Drive, Medford, OR  97501 during normal business hours Monday through Friday or online any time at KTVL.com.  Entry packets and materials submitted to Opus Broadcasting will not be returned.  One submission per musical group.  No lewd, crude, offensive, prejudiced, sexist or negative content, as determined by  Opus and the Station  in their sole and absolute discretion will be accepted, and subject to disqualification. 

3.  The contest starts on May 8, 2013 and all entries must be received by Station and Opus  by 5:00 p.m. PDT on  July 31, 2013.  The Station and Opus are not responsible for any late, lost, or misdirected entries, server unavailability, computer or any other electronic malfunction.   Each musical group must indicate a single member as authorized to represent the wishes and decisions of the entire group.          

4.  All entries received that are duplicate, incomplete, mutilated, tampered with, incorrect, illegible, or from ineligible entrants will be void.  All entries become the property of Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc., Opus, and the Station and will not be acknowledged or returned.

Judging of Entries/Finalist Selection 

1.  Each eligible entry will be judged and scored by a panel of 4 judges comprised of Opus & Station personnel based on the following criterion: 40% Song Writing Skill, 30% Production Value, and 30% Creativity.  The judges will determine twenty-four (24) bands based on the score for the criterion set forth above.   The decisions of the judges shall be final.

2. Each of the twenty-four (24) bands will be announced on KROG and will also be notified by telephone.  If Opus  cannot contact a band to confirm their participation in the competition within forty-eight (48) hours of being announced on KROG, , then the band will be disqualified and another eligible musical group with the next highest score will be chosen by the judges as a participant  in the competition.

Contest Competition Rounds

1.  Each of the bands will compete in 12 rounds of a musical competition to determine the winning musical group.  All competitions will take place at Havana in Medford.   The first round will take place over 6 consecutive Wednesday nights, and the quarter and semi-final rounds will take place over the following 6 consecutive Wednesday nights, according to the schedule below.  The final round will take place on Wednesday, September 11, 2013.

3.   Opus will determine and notify each finalist of the dates and order in which each finalist is to perform.  Each band must be ready and available to perform on the scheduled dates, in their scheduled order, and on time.  Bands not available and ready to perform as scheduled will be disqualified and eliminated from further competition.

4.   On each Wednesday during each round of competition, four bands will compete against one another by each playing a twenty-minute set of original music on stage before a live audience.  Any musical group going over the 20-minute allotment, disregarding the directions of Opus personnel or engaging in inappropriate, lewd or offensive conduct as determined by Opus will be disqualified and eliminated from further competition.  At the conclusion of each competition, audience members will “vote” for their favorite band by placing their event wristband into a box designated for the finalist group.  One “vote” per audience member.   The (2) bands  with the most “votes” will advance to the following round. Of the eight (8) bands eliminated in the quarter finals, the two (2) eliminated bands with the most audience votes will advance to the semi-finals, which means that a total of eight bands will advance to the semi-final rounds of competition.

5.   On Wednesday Sept 11, 2013, the four remaining finalists will compete against one another by each playing a twenty (20)-minute set of original music on stage before a panel of no less than 3 judges to be selected by Opus .  At the conclusion of the four performances, the audience will vote by placing their event wristband into a box designated for their favorite band.  One “vote” per audience member.   The judges will determine  one (1) grand prize winner based on the following criterion: 20% Song Writing, 20% Stage Presence, 20% Showmanship, and 20% Musicianship, 20% audience vote. In the event of a tie, the winner will be determined by judges in their sole and absolute discretion. 

The Prize(s) 

1.  One (1) grand prize winning band will receive  $5,000 provided by OPUS.  Musical group members are responsible for allocating the grand prize amongst themselves. 

2. Winner will be announced at the conclusion of voting on September 11, 2013.  All members of the grand prize winning band must sign the release and affidavit of eligibility at the time the prize is claimed in person  at Opus Broadcasting, 511 Rossanley Drive, Medford, Oregon during regular business hours and within ten (10) business days of winning, excluding holidays.  Each member of the grand prize winning band must present a valid government issued photo identification in order to claim the prize.  Opus reserves the right to request additional identification.

3.  If  all members of the winning band do not timely sign and return the release and affidavit of eligibility, then the prize will be forfeited, and the prize will remain the property of Opus.  The winner will then lose all claims and rights to the prize.

4.  No transfer or assignment of prizes is allowed.

5. Each winner is responsible for paying all local, county, state and federal taxes on prizes based on the estimated retail value of the prizes as set forth in these rules.   Winner must sign a W-9 form.  

6. WSMH, Inc., Sinclair Broadcast Group, Inc. and Sinclair Television Group, Inc. are not liable if the provider of any part of the prize fails to satisfy its obligations to furnish its portion of the prize. 

7.Opus Broadcasting,  WSMH, Inc., Sinclair Broadcast Group, Inc. and Sinclair Television Group, Inc. are not responsible for any liabilities arising directly or indirectly from the award or use of the prize.

8. In claiming your prize, you acknowledge that Opus Broadcasting, WSMH, Inc., , Sinclair Broadcast Group, Inc. and Sinclair Television Group, Inc. have the right to publicize your name, character, likeness, photograph, voice and the fact that you are the winner for promotional purposes without financial remuneration.

2.  For a list of prize winners, send a separate, self-addressed, stamped envelope to Opus Broadcasting, 511 Rossanley Drive, Medford, Oregon 97501.

3.  This contest is subject to all applicable laws and regulations and is void where prohibited.  Opus Broadcasting, Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc.WSMH, Inc., Legacy Entertainment dba Havana Nightclub, Opus Broadcasting dba KROG, and The Douglas Group, Inc. dba UPICKEM, accept no responsibility or liability in connection with any injuries, losses or damages of any kind caused by or resulting from the acceptance, possession or use of any prize awarded hereunder.

4. Opus Broadcasting, WSMH, Inc.,Sinclair Broadcast Group, Inc. and Sinclair Television Group, Inc. cannot be held liable for any lost or stolen entries, prizes or contest information. 

5. Opus Broadcasting, WSMH, Inc., Sinclair Broadcast Group, Inc. and Sinclair Television Group, Inc. reserves the right to make rules and contest changes and change the aforementioned contest dates.
